The short version: We collect only what we need to sell you a play gym, ship it, and support you afterward. We never sell your personal information for money. We never collect or store medical or health information. We do use advertising cookies, which some state privacy laws treat as “sharing”, and you can opt out at any time. You can ask us what we have about you, or ask us to delete it, any time at info@brainrichkids.com.

Who we are

What we collect

  • Order information: your name, email, phone number, shipping and billing address, and details of what you purchased — because we need them to process your order, deliver it, and help you afterward.
  • Payment information: processed entirely by Shopify's PCI-compliant payment systems and their payment partners. We never see or store your full card number.
  • Browsing information: like most websites, we automatically receive your IP address, browser, and device type, and we use cookies to keep your cart working and understand how visitors use our site.
  • Things you choose to share: quiz answers (ceiling height, kids' ages) to recommend the right gym; messages you send our support team; reviews you post; and photos or videos you share with us — which we only publish with your permission.
  • Marketing preferences: if you join our email list or text program, we store your contact details and preferences until you unsubscribe.

What we do NOT collect

  • Medical or health information — none, ever. If you choose to pay with HSA/FSA funds, the short health survey is completed directly with an independent platform and its licensed providers. Your answers and any Letter of Medical Necessity are handled by them under their own privacy and healthcare-compliance obligations. Brainrich never receives, sees, or stores your health information.
  • Children's information. Our products are for kids, but our website is for their grown-ups. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, email us and we will delete it.

How we use your information

To process and deliver orders; provide support (including FaceTime assembly help you request); recommend products through the quiz; send marketing emails or texts you signed up for; understand how our site performs; and prevent fraud. That's the list.

Who we share it with  and who we don't

We share personal information only with service providers who need it to do their job for you: Shopify (our store platform and payment processing), shipping and freight carriers (name and address, so your gym arrives), our email and SMS platforms (to send messages you've opted into), our review platform (to verify you're a real customer), and analytics and advertising platforms in aggregate or cookie-based form. Each provider is bound to use your information only to provide their service. We may also disclose information if the law requires it.

We do not sell your personal information for money, and we do not give it to anyone to use for their own independent marketing.

Some of the advertising and analytics tools we use, including cookies and pixels from Google, Meta, Pinterest, TikTok, Snapchat, and Microsoft, involve sharing limited information with those companies so they can measure and target ads. Under California law and several other state privacy laws, that activity can count as “sharing” or a “sale” of personal information even though no money changes hands. You can opt out at any time through our Privacy Rights page, or by turning off advertising cookies in your browser.

When we pass information to another company, it is either under a service provider arrangement, which contractually limits that company to using it only to provide the service we hired them for, or because you asked us to, as with Google Customer Reviews. Companies that act on their own behalf rather than ours, including Google, handle your information under their own privacy policies and terms. We are not responsible for, and do not control, how those companies use information once it has been lawfully shared with them.

Cookies and analytics

We use cookies for the essentials (cart, checkout, security) and analytics (Google Analytics) to see how visitors use the site. We also use Google Ads, which tells us when a visit from one of our ads turns into an order. Advertising cookies may be used to show you relevant ads on platforms like Google, YouTube, Meta, Pinterest, TikTok, Snapchat, and Microsoft. Google and other third parties may place or read cookies in your browser, or use web beacons, pixels, and similar technologies, to collect information about your visit. You can control cookies in your browser settings; you’ll still be able to browse, though the cart needs cookies to work.

Google Customer Reviews

After you place an order, we may ask if you’d like to take part in Google Customer Reviews. If you opt in, Google sends you a short survey about your experience, and your rating may be shown alongside our store on Google. To make that work we share order details with Google, including your email address, order number, order value, and estimated delivery date, and Google may receive information about transactions you complete on this site.

As part of this and our other advertising and analytics tools, Google and other third parties may place or read cookies in your browser, or use web beacons, pixels, and similar technologies, to collect information about your visit. You can decline the survey invitation when it appears, and you can control cookies in your browser settings as described above.

Email and text messages

You only get marketing from us if you opted in. Every email has a one-click unsubscribe; reply STOP to any text to end texts immediately. Order and shipping notifications are sent to everyone who purchases, because you need them.

Your rights

Email info@brainrichkids.com to ask what personal information we hold about you, correct it, or have it deleted (we'll keep only what the law requires us to keep, like tax records). We respond to every request, regardless of where you live.

California residents: you have the rights to know, delete, correct, and opt out of the “sale or sharing” of personal information under the CCPA/CPRA. Because we use advertising cookies and pixels, California law may treat some of our advertising activity as sharing personal information for cross-context behavioral advertising. You can exercise any of these rights at info@brainrichkids.com or via our Privacy Rights page, and we will never treat you differently for doing so.

How long we keep it, and how we protect it

We keep order records as long as needed for taxes, warranty, and support, and marketing data until you unsubscribe. Data is stored on Shopify's secure, encrypted infrastructure behind industry-standard protections (SSL/TLS in transit, encryption at rest).

Text message (SMS) marketing

If you opt in to text messages from Brainrich Kids, we use your phone number to send the messages you signed up for, such as promotions, restock alerts, order updates, and cart reminders. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any message, and you can text HELP for help.

Our website uses cookies to keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages by text message.

Text messaging originator opt-in data and consent are never shared with or sold to any third parties for their own use. Any data sharing described elsewhere in this policy excludes text message opt-in data and consent.

Changes to this policy

If we make meaningful changes, we'll update the date at the top and post the new version here. Continued use of the site after changes means the current version applies.
