Partner Program Terms

These are the terms of the Brainrich Kids Partner Program. We have written them to be read, not to be skimmed past. If anything here is unclear, email us and ask.

1. What this is

The Brainrich Kids Partner Program lets approved partners earn a commission by referring customers to brainrichkids.com. By applying, you agree to these terms.

We can update these terms, and we will email you at least 14 days before any change that affects your commission.

2. Who can join

We review every application by hand. We look for partners who create original content for parents of active children: bloggers, creators, podcasters, pediatric occupational and physical therapists, educators, homeschool publishers, and parents with a real audience.

We do not have to explain a rejection, and we can close an account at any time.

You must be 18 or older.

3. What you earn

Commission is calculated on the product subtotal after discounts and before shipping, tax, and fees.

4. How tracking works

You get two things:

1. A referral link. Clicks are cookied for 45 days.
2. A personal discount code. Your audience gets $100 off. The code works whether or not they clicked your link, so it catches people who heard about us from you and came back later.

If an order carries both your code and another partner's link click, the code wins.

If two partners' links touched the same customer, the most recent click inside the window is credited, unless that click came from a coupon, cashback, or extension domain, in which case it is voided and credit goes to the prior legitimate partner.

Your code is exclusive to you, capped, one use per customer, and does not stack with other promotions.

5. When and how you get paid

• Payments run monthly, on the 15th, covering the prior month
• Commission is held for 45 days from the order date before it becomes payable
• Minimum payout is $50. Balances below that roll forward
• PayPal is the default method. Store credit is available at 1.25x the cash value if you prefer

Commission is reversed on any refunded, cancelled, charged-back, or fraudulent order. If a reversal happens after you were paid, it comes out of your next payout.

Tax. You are an independent contractor, not an employee, and you are responsible for your own taxes. US partners must supply a W-9 before cumulative payouts reach $600. If we pay you by ACH, wire, or check and you earn $600 or more in a calendar year, we file a Form 1099-NEC by January 31. If we pay you through PayPal, PayPal handles the reporting instead.

6. Rules you have to follow

Disclose the relationship

This is not optional and it is not negotiable. The FTC requires you to disclose a material connection clearly, conspicuously, and before the recommendation, in the same place people see the recommendation.

Not acceptable: a disclosure buried at the bottom of a post, hidden behind "more," inside a pile of hashtags, or on a separate page. Video and audio need a spoken or on-screen disclosure, not just a description line.

Failure to disclose is grounds for immediate removal and forfeiture of unpaid commission.

You may not

• Bid on "Brainrich," "Brainrich Kids," "brainrichkids.com," or misspellings of them in any paid search or shopping ad
• Use Brainrich in a paid ad's display URL or as a domain you own
• Post your code on any coupon, deal, cashback, or aggregator site, or allow it to be posted
• Email your link to a purchased, rented, scraped, or non-opted-in list
• Buy your own referral, or refer members of your household
• Create accounts, sites, or profiles that imply you are Brainrich Kids
• Use cookie stuffing, forced clicks, iframes, pop-unders, or automated redirects
• Modify our images or copy in a way that changes what they claim

Claims you make about the product

Please be accurate. Specifically:

• Ages 3 and up for independent climbing. Younger siblings only with a parent's hands close by.
• 220 lb rated, tested to 440 lb. Do not present 440 as the capacity.
• No Brainrich gym includes or sells a slide. Do not say we do.
• No drilling required.
• Never imply unsupervised play. Say "in the same room."
• Developmental and health claims stay associational ("linked to," "associated with"), never "proven," "causes," or "cures."
• No fabricated clinical or professional endorsements.

We give you an approved-claims sheet in your partner dashboard. Use it.

Brand assets

You may use the logos, photography, and video in your partner dashboard to promote Brainrich Kids. That permission ends when your account does. You may not alter the logo, use it as your own, or register anything confusingly similar.

7. Ending the relationship

Either of us can end this at any time, in writing, for any reason.

If you end it, or we end it for ordinary reasons, you keep commission already earned on valid orders, subject to the hold period.

If we end it for a violation of Section 6, unpaid commission is forfeited. Tracking stops on the termination date. Orders placed after it do not earn commission even if the click happened earlier.

8. The legal part

You are an independent contractor. This is not an employment relationship, a partnership, or a joint venture. You cannot bind Brainrich Inc to anything.

We provide the program as-is. We do not guarantee any level of earnings, uptime, or tracking accuracy, and we are not liable for indirect or consequential damages. Our total liability to you is limited to the commission owed on valid orders.

You agree to indemnify Brainrich Inc against claims arising from your promotional content, your disclosures, or your breach of these terms.

These terms are governed by the laws of the State of Florida. Disputes go to the state or federal courts in Palm Beach County, Florida.
